Waiver of Liability for Truth Alchemy Activation Journeys

The purpose of this release and waiver (the “Waiver”) is to openly communicate the risks associated with Truth Alchemy Activation Journeys and to have you release P.S. I’m Ella of any liability. Please be aware that if you do not sign this Waiver and agree to its terms, you will not be able to participate in or benefit from the Truth Alchemy Activation Journeys services.

You must be at least 18 years old to participate, without exceptions. In addition, Truth Alchemy Activation Journeys are not suitable for anyone who suffers from severe post-traumatic stress disorder (PTSD), bipolar episodes, mental instability, severe anxiety attacks, a history of mania, delusion, or psychosis, or any other severe mental, emotional, or personality disorders. If you suffer or have suffered from any of the above-mentioned conditions, you must provide written consent from your physician before participating.

There are no refunds for this session.

1) Parties

We will refer to P.S. I’m Ella, a Sole Proprietorship based in the Province of Quebec, as “P.S. I’m Ella,” “we,” “us,” or “our.” We will refer to you, the undersigned (electronically or by hand), or the person who has clicked “I Agree” to this Waiver, as “you” or “your.”

2) The Services

Truth Alchemy Activation Journeys.
Truth Alchemy Activation Journeys are an energy-based, consciousness-oriented practice that supports the mind, body, and spirit in expansion, self-healing, and deepened connection. These sessions are facilitated online and may involve being seen on camera via Zoom.

Truth Alchemy Activation Journeys are not a substitute for medical or psychological attention, examination, diagnosis, or treatment. These sessions are not replacements for medical care, psychotherapy, or treatments prescribed by licensed healthcare professionals.

3) Inherent Risks

You understand that participation in the Services involves inherent risks and potential side effects, some of which may be serious. These risks may result in injury or changes to your quality of life, and you acknowledge and accept these risks knowingly and voluntarily.

Potential risks and side effects may include, but are not limited to:

Physical injury such as muscle strains, tears, sprains, fractures, cardiovascular complications, changes in blood pressure, dehydration, dizziness, fainting, or other musculoskeletal or physiological responses.

Over-supplementation or improper supplementation resulting in allergic reactions, toxic overload, digestive distress, headaches, or worsening of existing symptoms, as well as exercise-related injuries such as dizziness or muscle strain.

Emotional, psychological, or physiological responses including distress, fatigue, disorientation, emotional release, or discomfort related to lifestyle changes, confronting personal challenges, or the surfacing of previously suppressed emotions or memories during energetic or consciousness-based processes.

If you are pregnant, recently postpartum, or nursing, there may be additional risks to your body and to fetal or infant health, including but not limited to pregnancy loss, low birth weight, early delivery, or postpartum complications.

4) Affirmation of Health

By agreeing to receive the Services, you affirm that you have consulted with a qualified healthcare professional and determined that participation does not pose a significantly increased risk to your health. If you have any pre-existing medical conditions, physical injuries, mental health conditions, are pregnant, postpartum, or nursing, you agree to consult your physician prior to participating.

You agree to immediately inform P.S. I’m Ella if at any point during the Services you feel unwell or unsafe.

5) Medical Disclaimer

You understand and acknowledge that P.S. I’m Ella is not a licensed medical or mental health professional and that the Services do not constitute medical advice, diagnosis, or treatment.

Any lifestyle, wellness, dietary, or energetic suggestions offered are optional and undertaken at your own discretion. You accept full responsibility for any choices you make regarding your physical, emotional, or mental health and agree to seek appropriate professional care when needed.

Truth Alchemy Activation Journeys are not intended to diagnose, treat, cure, or prevent any disease, condition, injury, or mental or physical disorder.

6) Voluntary Assumption of Risk

By clicking “I Agree” and participating in the Services, you confirm that you have read and understood this Waiver and voluntarily assume all risks associated with participation in Truth Alchemy Activation Journeys.

7) Release, Waiver, and Indemnity

You hereby release, waive, hold harmless, and indemnify P.S. I’m Ella, including its officers, contractors, employees, volunteers, agents, successors, family members, and assigns (the “Released Parties”), from any and all liability, claims, demands, damages, or causes of action arising out of or related to your participation in the Services.

This includes, without limitation, claims arising from personal injury, illness, emotional distress, or death, including exposure to communicable diseases such as COVID-19, whether caused by negligence or otherwise.

You knowingly and voluntarily waive any right to legal action against the Released Parties and agree that this release applies to you and to any heirs, executors, or representatives who may act on your behalf.

8) Continued Agreement

Your acceptance of this Waiver applies to all current and future Truth Alchemy Activation Journeys, sessions, workshops, programs, and Services offered by P.S. I’m Ella, whether online, in person, or via video conferencing platforms.

9) General Legal Provisions

Governing Law & Venue. This Waiver shall be governed exclusively by the laws of the Province of Quebec, Canada.
Severability. If any provision of this Waiver is found unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement. This Waiver constitutes the entire agreement between the parties and supersedes any prior agreements.
Headings. Headings are for convenience only and have no legal effect.
Electronic Agreement. This Waiver may be signed electronically or accepted by clicking “I Agree,” with the same legal effect as a handwritten signature.
